3. On what legal basis are my data being processed?

In accordance with the privacy law and the Regulation, we process personal data on the following legal grounds:

Based on the execution of a contract as agreed upon with the User, or the completion of pre-contractual measures at the User's request;

Or

Based on compliance with legal or regulatory provisions regarding the management of the contractual relationship, particularly invoicing;

Based on our legitimate interest in sending information and newsletters to our clients;

Based on your explicit consent for sending promotional offers (direct marketing).

4. What personal data is processed?

BRUYERRE is committed to collecting and processing only relevant and necessary personal data to achieve the purposes for which they are processed. The following categories of personal data are processed:

• Personal identification data (name, first name, address);
• Contact details (phone number and email address);
• Financial identifiers (banking data: we retain only necessary data, and always in compliance with GDPR);
• Electronic identification data (IP address, location, cookies);
• Optional personal data (gender, date of birth);
• Date and time of website access;

• Platform and/or operating system installed on PC/Smartphone;
• Search engine and keywords used to find the website.

5. What purposes will my personal data be used for?

BRUYERRE collects your personal information to provide each User of our platform with a secure, optimal, and personalized user experience. The collection of personal data may intensify as the User makes more intensive use of the platform and our online services. BRUYERRE reserves the right to suspend or cancel certain operations if data is missing, incorrect, or incomplete.

Data processing is essential for the operation of the platform and related services. Processing is exclusively carried out for the following specific purposes:

• Customer management: customer administration, order management, deliveries, invoicing, solvency checks, support, complaint tracking, and newsletter sending.
• Dispute management.
• Protection against fraud and offenses.
• Personalized marketing and newsletter, if you have expressly agreed. In this case, you are free to withdraw your consent at any time.

The user always provides personal data themselves and can thus exercise a certain degree of control. If some data is incomplete or apparently incorrect, BRUYERRE reserves the right to temporarily or permanently postpone certain expected operations.

6. Who receives your personal data?

Your personal data will be processed only for internal use within BRUYERRE. Your personal data will not be sold, transmitted, or communicated to third parties, except with your explicit and prior consent.

7. How long do we retain your personal data?

Your data will be retained for a period of 10 years from the end of the customer or prospect relationship. The period starts from either the last order, the last login to the customer account, the last call to customer service, the last email sent to customer service, clicking on a hyperlink in an email sent by BRUYERRE, adding products to the cart without finalizing the purchase, or a positive response to an email asking if the customer wishes to continue receiving commercial prospecting at the end of the five-year period. After this period, customer or prospect data will be anonymized.

However, information that serves as evidence of a right or contract, or is retained for compliance with a legal obligation, may be archived in accordance with applicable legal provisions.

8. What are your rights?

8.1 Guarantee of lawful and secure processing of personal data

Your personal data will always be processed for legitimate purposes, as outlined in Article 5.

They are collected and processed in an appropriate, relevant, and proportionate manner, and are not retained for longer than necessary to achieve the established objectives.

8.2 Right of access

If you can prove your identity, you have the right to obtain information about the processing of your data. This grants you the right to review the purposes of processing, categories of personal data, categories of recipients to whom data has been sent, criteria determining the data retention period, and the rights you can exercise regarding your data.

8.3 Right to rectification of personal data

Inaccurate or incomplete data can be corrected. It is first up to the User to make necessary changes in their 'User Profile'. You can also address us with a request for modification.

8.4 Right to erasure of your personal data

You also have the right to obtain the erasure of your personal data in the following cases:

• Your personal data are no longer necessary for the intended purpose;
• You withdraw your consent for data processing and there is no other legal basis justifying data processing;
• You have legally objected to the processing of your personal data;
• Your data is processed unlawfully;
• Your data must be erased due to a legal obligation.

Data deletion is primarily linked to their visibility; deleted data may be stored temporarily.

8.5 Right to restriction of processing

In certain cases, you have the right to restrict the processing of your personal data. This is especially the case in instances where there are disputes about the accuracy of the data, if the data is needed in a legal proceeding, or for the time necessary for BRUYERRE to verify that you can validly exercise your right to erasure.

8.6 Right to object

You have the right to object at any time to the processing of your personal data for direct marketing, profiling, or for purposes arising from the legitimate interests of the data controller. BRUYERRE will cease processing your personal information, unless BRUYERRE can demonstrate compelling legitimate grounds for processing that override your right to object.

8.7 Right to data portability

You have the right to obtain from BRUYERRE all the personal data you provided to us in a structured, commonly used, and machine-readable format. You also have the right to transfer this personal data to another data controller, unless this is technically impossible.

8.8 Right to withdraw your consent

You have the right to withdraw your consent at any time, for instance when you have given it for direct marketing purposes.

9. How can you exercise your rights?
